Terms of Service
Welcome to Build Advice – we’re glad you’re here. We believe transparency builds trust, so these are our clear, plain-English terms.
1. About our services
Build Advice provides general information and insights to help you understand building and renovation options. We’re not licensed builders, architects, engineers, or legal advisers, and we don’t give professional recommendations, referrals, or endorsements. Everything on this website and anything you receive from us is general information only.
2. Make your own assessments
Always make your own enquiries, check with licensed professionals, and rely on your own judgment before acting on anything we say or publish. Nothing we provide is a substitute for advice tailored to your personal circumstances.
3. Confidentiality
If you submit personal or project details through our website or during any engagement, we’ll treat that information as confidential and:
• only use it to provide our services or respond to your enquiry;
• store it securely and protect it from misuse or unauthorised access; and
• not share it with anyone else unless you’ve agreed, we’re required by law, or it’s necessary to deliver our services (e.g. trusted IT/hosting providers under confidentiality).
Please do not upload sensitive or private documents through our website unless specifically requested. Confidentiality doesn’t apply to information that is already public, known to us independently, or required by law to be disclosed.
4. No promises or guarantees
We do our best to keep information accurate and up to date, but we can’t promise that everything is perfect, complete, or suitable for your purpose. We make no warranties or guarantees about the accuracy, quality, or fitness for purpose of our Services or content. We sometimes link to third-party sites or content. We don’t control them, and we’re not responsible for what they say or do.
5. Insurance
We maintain appropriate professional indemnity and public liability insurance and can provide a certificate of currency upon request.
6. Limiting our liability
To the maximum extent allowed by Queensland and Australian law, we are not liable for any loss or damage you suffer because you relied on our information, except where the law says otherwise.
We’re not responsible for indirect, consequential, or special loss (like lost profits, time, or opportunities). If any liability can’t legally be excluded, our total liability is limited to the amount you paid us for the relevant Services. We are not responsible for any loss or claim suffered by anyone else who uses or relies on our information, recommendations or advice, even if you share it with them. You agree to indemnify us for any claim made by a third party arising from your use of our site or services.
7. Intellectual Property
Any materials, reports, or documents we create remain our intellectual property. You have a non-exclusive license to use them for your personal or business purposes related to the project, but not to copy or resell them.
8. Privacy and data protection
We handle personal information in accordance with our Privacy Policy (buildadvice.com.au/privacy-policy.) We don’t share or sell your data, and we take reasonable steps to protect it. If you provide us with a testimonial, you agree that we may use it on our website, social media, or any advertising or marketing for our services, using only your first name and any images you supply us with or consent to us using (including your project or personal image). If you later ask us to remove it, we will do so within a reasonable time.
9. Unexpected delays and events outside of our control
We’re not responsible for delays or failures caused by events beyond our reasonable control, such as natural disasters, internet outages, government restrictions, industry shutdowns, industrial action or illness. We may also (with your understanding) engage third parties to support the provision of services, who might also suffer unforeseen events. In such circumstances we will use our best efforts to resume work as soon as reasonably possible, and work with those parties to deliver the services.
10. Keeping things fair
You agree not to directly hire or engage our team members or contractors for similar services during or for six months after this Agreement without our consent. Before taking any dispute to court, we both agree to try to resolve it in good faith through discussion and, where we agree that it is appropriate, through alternative dispute resolution such as mediation.
11. About these terms
By using our site or services, you accept these Terms of Service. If any part is invalid or unenforceable, the rest still applies. We may update these Terms of Service occasionally to stay clear and compliant. When we do, we’ll note the “last updated” date and, for major changes, post a notice on our website. By continuing to use our site or services after that, you agree to the updated version. Our Agreement can be signed electronically, and it has the same effect as a handwritten signature. These terms are governed by the laws of Queensland, Australia.
